The Martinsburg Terms & Conditions

General:

By submitting this reservation, you, the tenant, agree that you have read, understood and accepted the terms in the rental agreement. By submitting this reservation, you, the tenant, authorize the applicable total (including all applicable State and local Hotel Taxes) be charged to the credit card provided at the time of booking, as well as any balance due to be charged on the credit card at least 14 days prior to check in. You also agree that The Martinsburg has your permission to charge the card on file for any incidentals or damages found, of which you will be notified, no later than 10 days after your reservation date. Guests must be 21 years or older to reserve a cabin at The Martinsburg. Any children must be 14 years or older. 

We take great pride in our property and its appearance.  We want this to be a positive experience for all our guests and ask you to please treat the cabin and the grounds as gentle as possible. 

Entry of Premises:

Guest entry instructions: The Martinsburg is a fenced property that requires a code to enter the main gate located at the driveway. The cabins are equipped with smart locks, a digital lock that requires a unique code to enter. This code is reset after each guest's stay. Access codes for both the main gate, as well as for your individual cabin will be sent to you per text message on the day of  your arrival.

By booking, you authorize The Martinsburg to send you text messages and emails with details regarding your reservation information and other offers. Message/data rates may apply. Consent is not a condition of purchase. 

Cancellation Policy:

Your card is charged 50% of the entire amount due at time of booking. Unless you booked a “Rest Easy Rate” with flexible cancellation, the following cancellation policy applies for the Standard Rate: 

If you cancel prior to 14 days of your arrival, we will provide a refund minus $50 cancellation fee.  Cancellations within 14 days prior to arrival are not possible.  Your card on file will be charged with the remaining 50% due 14 days prior to arrival. 

If you book within 14 days of arrival, the entire amount due will be charged to your credit card at time of booking.  

Occupancy Policy:

Each reservation for a Studio cabin includes a maximum of two occupants. Each reservation for the 1-Bedroom cabin includes a maximum of four occupants. 

This property is not suitable for children.  Children under the age of 14 are not allowed on the property.  Children under the age of 18 must be accompanied by an adult at all times.  

Only the disclosed number of guests are allowed into the property. We don't allow additional guests on the property that are not part of the reservation. We also do not allow visitors that are not pre-disclosed to us prior to their visit. Absolutely, no undisclosed guests, you will be asked to leave, and no refund will be given.

Check-In/Check-Out Policy:

The Martinsburg has the following Check-In and Check-Out policy:

Check-In: 4:00pm on day of arrival.

Check-Out: 11:00am on day of departure.

Pet Policy:

While we love animals, unfortunately we do not allow pets in the cabins or on the property at this time for the comfort of all of our guests. Only official service dogs are allowed. Service dogs do not include emotional support of comfort dogs. You can read more about requirements for service animals at the following website: https://www.ada.gov/topics/service-animals/.

Violations will be subject to a $500 fine to cover additional cleaning fees.

No Smoking/ Candles Policy:

Smoking is prohibited anywhere on the premises. This includes the use of tobacco, cannabis, e-cigarettes, etc. If this rule is broken, you will be fined $200. Smoking is strictly prohibited both inside and outside the cabins due to the high fire risk posed by the dry area. The use of candles, or any open flame objects inside the property is also prohibited. If the policy is broken, you will be fined $200.  If the smoking or candle policy is broken a second time, you will be asked to leave, and no refund will be given.

Property Damages/Extra Cleaning:

Your occupying the rental property acknowledges that you agree that you shall pay additional charges, should they be incurred, as well as all administrative and / or legal charges of collecting these charges, for damages beyond normal wear and tear, including but not limited to food and/​or drinks spilled on bedding, furniture, etc.

Disclosure of damages caused to property and its contents must be made to The Martinsburg at the time they occur. Reasonable repair or replacement costs based on the item(s) replacement value and/or labor and materials to repair will be assessed and charged to the guest. Extra cleaning costs: If the cabin is in a condition where extra cleaning is required, you agree to be charged an extra cleaning fee depending on how the property is left. We ask to please follow check out instructions and all house rules to avoid this. 

Hot Tub Policy: 

Use of any hot tub carries risk that may result in serious injury or death. Children 14 years or older must be supervised by an adult at all times. The American College of Obstetricians and Gynecologists (ACOG) state that becoming overheated in a hot tub is not recommended during pregnancy. Elderly persons and anyone subject to heart disease, diabetes, low or high blood pressure, strokes, epilepsy or other health conditions should not enter the hot tub without first consulting their physician. Never use a spa while under the influence of drugs or alcohol or if you are taking medications of any kind or being treated for any illness. The spa should be kept at a temperature less than 104 degrees for personal safety and all bathers must shower before and after use to decrease the possibility of skin problems. DO NOT SIT OR WALK ON THE SPA COVER, or it can collapse.

NO bath bombs, oils, salts or bubbles of any kind inside the hot tub. Nothing should be added to the water. If the hot tub is found in any condition where these products were used during your stay, there will be an additional $200+ cleaning fine, depending on the condition of the hot tub.

Firepits and BBQ Grill Policy:

There are open fire pits and gas grills on the property. To prevent wildfires, no open fires are allowed outside the dedicated fire pits and gas grills. Outside BBQ grills or smokers are prohibited from being brought on to the property. Use of any open firepit carries risk that may result in serious injury or death. Children 14 years or older must be supervised by an adult at all times.

Please note that depending on drought conditions, Gillespie County may issue a burn ban that must be strictly adhered to.  No fires are then allowed at all anywhere on the property.  

Septic System:

We are located on a rural property with a septic system. Please be gentle with plumbing fixtures. Please do not flush anything down the toilet except natural waste and toilet paper. Please do not flush any other products, including wipes, paper towels and sanitary products.

Wildlife:

For your personal safety, please note that we are located on a rural area in the Hill Country, which means you may have an occasional encounter with wildlife (racoons, possums, snakes etc).  Please be aware of your surroundings and take caution. You may also encounter various bugs, spiders, scorpions, and mice that sometimes make their way inside.  While pest control services are utilized regularly, this does not guarantee the eradication of these critters. We also have an abundance of birds on the property, and we encourage you to enjoy their presence.  They are especially active in the early morning hours.  

Release and Waiver of Liability and Indemnity Agreement:

By booking this reservation, you the tenant For being permitted to enter the premises and property for short-term rental or any other purpose, the undersigned, for himself/herself, his/her personal representatives, guests, children, heirs, and next of kin, acknowledges, agrees, and represents that he/she has or will immediately upon entering, and will continuously thereafter, thoroughly inspect such areas and his/her continued presence constitutes an acknowledgement that he/she has inspected house, deck and entire property and he/she finds and accepts such areas as being safe and reasonably suited for the purposes of his/her use, and he/she further agrees and warrants that if, at any time, he/she feels anything to be unsafe, he/she and all guests will immediately notify the host and advise appropriate persons. THE UNDERSIGNED hereby RELEASES, WAIVES, DISCHARGES AND COVENANTS NOT SUE, owner personally and as company or corporate representatives, their members, managers, operators, officials, officers, directors, employees, owners and/or lessees of the premises, all for the purposes herein referred to as “releases”, for all liability to the undersigned, guests, representatives, assigns, heirs and next of kin for any and all loss of damage, and any claim or demand thereof on account of property damage, illness or INJURY to the person(s), or resulting in DEATH of the undersigned or guests, whether caused by negligence of the releasees or otherwise while in or upon the area. THE UNDERSIGNED hereby AGREES TO INDEMNIFY AND SAVE AND HOLD HARMLESS the releases and each of them from any loss, liability, damage, or cost they may occur due to their presence in or upon the area and whether caused by the negligence of the releases, natural risky conditions or otherwise.
